Terms of Service & Privacy Policy

This document contains two parts. Part A sets out the Terms of Service that govern your use of Clarity Senior Transitions’ website and services, including our SMS and email communications programs. Part B sets out our Privacy Policy, which explains how we collect, use, and protect your information. Together they form a single agreement. By using our services or opting into our communications, you agree to both parts.

Part A — Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by Clarity Senior Transitions (“Clarity Senior Transitions,” “we,” “us,” or “our”), including our website, our senior living information, referral, navigation, and placement assistance services, and our SMS and email communications programs. By using our services or opting into our communications, you agree to these Terms and to our Privacy Policy set out in Part B of this document. If you do not agree, please do not use our services.

1.  Eligibility and Acceptance

Our services are intended for adults 18 years of age or older. By using our services, you represent that you are at least 18 years old and are acting on your own behalf or as an authorized representative of the senior for whom you are seeking assistance.

2.  Nature of Our Services; No Professional or Clinical Relationship

Clarity Senior Transitions provides senior living information, referral, navigation, and placement assistance to seniors and their families. These are non-clinical advisory and referral services. They are not, and are not intended to be, psychotherapy, mental health treatment, counseling, clinical social work, case management, life or wellness coaching, medical care, nursing care, or medical, healthcare, legal, or financial advice.

Susanne Mealer holds a license as a Licensed Clinical Social Worker (LCSW) in North Carolina. However, when providing services through Clarity Senior Transitions, Ms. Mealer is acting solely as a senior placement and referral advisor and is not acting in the capacity of, or providing the services of, a licensed clinical social worker. No clinical assessment, diagnosis, treatment, therapy, or clinical social work service is provided through Clarity Senior Transitions.

Your use of our website or services does not create a therapist-client, counselor-client, coach-client, healthcare provider-patient, clinical social worker-client, or any other clinical, treatment, or fiduciary relationship with Susanne Mealer or Clarity Senior Transitions. No such relationship is formed by contacting us, submitting information through our website, or receiving referrals, recommendations, or placement assistance. Our Professional Services Disclaimer is incorporated into these Terms by reference.

3.  Not Medical, Legal, or Financial Advice; No Guarantees

Information, options, and recommendations we provide are general in nature, are intended only to help you identify and explore senior living communities and related resources, and are not a substitute for individualized professional advice. We do not own, operate, endorse, warrant, or control any senior living community, care provider, or third-party service to which we may refer you, and we do not guarantee the availability, quality, safety, pricing, or outcome of any community, provider, or placement.

4.  Referrals and Compensation Disclosure

Clarity Senior Transitions may receive a referral fee or other compensation from senior living communities or providers when a placement is made. This compensation does not increase the cost to you and does not obligate you to select any recommended community. You remain free to consider and choose any community or provider, including those with which we have no relationship.

5.  Your Responsibilities

You and your authorized representatives remain solely responsible for independently evaluating any community or provider, verifying its licensure, services, availability, and suitability, consulting appropriate medical, mental health, legal, and financial professionals, and making all final decisions regarding care, housing, and placement. You agree to provide accurate information and to use our services only for lawful purposes.

6.  Emergencies and Crisis Situations

Our services are not for emergencies. If you are experiencing a medical emergency, a mental health crisis, or thoughts of self-harm, do not rely on this website or our services. Call 911, dial or text 988 (the Suicide and Crisis Lifeline), or seek immediate help from a qualified professional.

7.  SMS/Text Messaging Program

Program Description

Clarity Senior Transitions may send SMS and email messages to users who opt in. Messages may include promotional offers, service updates, appointment confirmations, and appointment reminders. Message frequency may vary.

Consent to Receive Messages

By providing your phone number and opting in, you authorize Clarity Senior Transitions to send text messages to your mobile number. Consent is not a condition of purchase.

Opt Out

You can cancel the SMS service at any time. Just text “STOP” to (980) 263-2897. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

Opt In Again

If you want to rejoin after opting out, you can opt in again using the same method you used to enroll originally.

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at info@clarityseniortransitions.com or 980-263-2897.

Message Frequency and Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive up to 4 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

8.  Privacy

Your use of our services and the messaging program is also governed by our Privacy Policy, set out in Part B of this document, which forms part of these Terms.

9.  Intellectual Property

All content on our website, including text, graphics, logos, and materials, is owned by or licensed to Clarity Senior Transitions and is protected by applicable law. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.

10.  Disclaimer of Warranties

Our website and services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11.  Limitation of Liability

To the fullest extent permitted by North Carolina law, Clarity Senior Transitions, Susanne Mealer, and their affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any decision you make regarding care, housing, or placement, arising out of or relating to your use of our website or services. Our total liability for any claim arising out of or relating to these Terms or our services will not exceed the amount you paid to us, if any, for the services giving rise to the claim.

12.  Indemnification

You agree to indemnify and hold harmless Clarity Senior Transitions and Susanne Mealer from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of our services or your violation of these Terms.

13.  Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or our services will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

We may update these Terms from time to time. Updates will be posted with a new Last Updated date, and your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

Part B — Privacy Policy

1.  Introduction

Clarity Senior Transitions (“we,” “us,” “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and protect your information when you use our website and services, including senior living referral and placement assistance, SMS marketing, email marketing, appointment reminders, and website tracking tools. By using our services or opting into our communications, you agree to this Privacy Policy and to our Terms of Service set out in Part A of this document.

Clarity Senior Transitions provides non-clinical senior living referral and placement assistance. Although our founder, Susanne Mealer, is a Licensed Clinical Social Worker (LCSW) in North Carolina, she does not act in a clinical capacity in providing these services, and Clarity Senior Transitions does not act as a covered entity under the Health Insurance Portability and Accountability Act (“HIPAA”). Any health-related information we collect is handled under this Privacy Policy and applicable state law rather than under HIPAA.

2.  Information We Collect

Contact information

We may collect your name, email address, phone number, and mailing address when you submit forms, book appointments, request information, or otherwise provide it to us.

Communications data

If you opt in, we collect your messaging preferences and maintain records of consent and opt-out activity related to SMS and email communications.

Health-related and family information

Because we help families explore senior living options, you may choose to share sensitive information such as a senior’s care needs, medical or health conditions, mobility or cognitive status, and family or financial circumstances. We collect this information only to the extent you provide it and use it solely to assist you with senior living referral and placement.

Usage and device information

We may use cookies, pixels, and analytics tools to collect information about how you use our website. This may include your IP address, browser type, pages visited, and interaction data.

Appointment and service data

If you schedule appointments or use our services, we may collect details associated with those interactions.

3.  How We Use Your Information

We use your information to:

  • Provide requested services and customer support

  • Identify, evaluate, and facilitate appropriate senior living communities and care options for you

  • Share your information with senior living communities or providers you ask us to explore, at your direction or with your consent

  • Send appointment confirmations and reminders

  • Send SMS and email communications that you have explicitly consented to receive

  • Maintain compliance records related to consent and opt-outs

  • Protect our business and users, including fraud and security monitoring

 

4.  Cookies and Tracking Technologies

We do not sell your personal information. We do not share mobile phone numbers, SMS opt-in data, or consent information with third parties or affiliates for marketing or promotional purposes. We may share information only in the following limited circumstances:

Senior living communities and care providers

To provide the placement and referral services you request, we share the contact, family, financial, and health-related information you provide with the senior living communities and care providers you ask us to explore, only as reasonably necessary to check availability and suitability and to help you consider those options. We do this at your direction or with your consent as part of delivering the service; this is not a sale of your information and is not sharing for third-party marketing purposes.

 

Service providers

We may share information with trusted vendors who help us deliver services, such as SMS and email delivery, customer support tools, scheduling tools, and analytics providers. These providers may only use information to perform services on our behalf.

Legal and safety

We may disclose information if required by law or to protect the rights, safety, and security of Clarity Senior Transitions, our users, or others.

Business transfers

If Clarity Senior Transitions is involved in a merger, acquisition, or asset sale, information may be transferred as part of that transaction. Any successor will be required to honor this Privacy Policy.

Third party sharing

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6.  HIPAA and Health Information

Clarity Senior Transitions is a private senior placement and referral business and is not a covered entity or business associate under HIPAA. Health-related information you share with us is protected under this Privacy Policy and applicable state law rather than under HIPAA. We treat this information as confidential and share it only as described in this Policy, including with the senior living communities and providers you ask us to explore.

7.  Your Choices

SMS opt out

You can opt out of SMS messages at any time by replying STOP to any message. After you send STOP, we will send a confirmation message and you will no longer receive SMS messages unless you opt back in.

Email opt out

You can unsubscribe from marketing emails by clicking the unsubscribe link in the email.

Placement information

You may ask us to stop sharing your information with senior living communities or providers at any time, although this may limit our ability to assist you with placement.

Access and correction

You may contact us to request access to, correction of, or deletion of your personal information, subject to applicable law.


 

8.  Data Retention

We retain your information for as long as necessary to provide our services, maintain consent and compliance records, and comply with our legal obligations, after which we securely delete or de-identify it.

9.  Data Security

We use reasonable administrative, technical, and physical safeguards to protect your information, including the sensitive health-related and family information you may share with us. No method of transmission or storage is fully secure, so we cannot guarantee absolute security.

10.  Children’s Privacy

Our services are directed to adults and are not intended for children. We do not knowingly collect personal information from children under 13, and we do not knowingly market our services to minors.

11.  Governing Law and Updates

This Privacy Policy is governed by the laws of the State of North Carolina. We may update this Privacy Policy from time to time. The updated version will be posted with a new Last Updated date.
